1. Acceptance of Terms
By accessing, browsing, or purchasing from the Moonarts website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use our website or services.
2. Products & Orders
All products displayed on our website are subject to availability. Prices are listed in Kenyan Shillings (KSH) and are subject to change without prior notice. An order is confirmed only upon receipt of full payment and written confirmation from Moonarts via WhatsApp or email.
Product images are for illustrative purposes. Due to the handcrafted nature of our goods, slight variations in colour, texture, and grain are inherent characteristics of genuine leather and are not considered defects.
3. Bespoke Commissions
Custom bespoke orders are subject to a separate consultation and quotation process. A non-refundable deposit of 50% of the total quoted price is required to commence work on any bespoke commission. The remaining balance is due upon completion and prior to delivery. Bespoke items are made to order and are therefore non-refundable and non-exchangeable, except in cases of demonstrable defects in craftsmanship.
4. Payment
We accept payment via M-Pesa and cash on delivery (for select areas within Nairobi). All payments must be made in full before dispatch of goods, unless alternative arrangements have been expressly agreed upon in writing. Moonarts reserves the right to cancel any order for which payment has not been received within 48 hours of order confirmation.
5. Delivery
We deliver within Nairobi and across Kenya via third-party courier services. Delivery timelines are estimates only and are not guaranteed. Moonarts shall not be liable for any delays caused by courier services, adverse weather conditions, or circumstances beyond our reasonable control. Risk of loss or damage passes to the buyer upon delivery to the specified address.
6. Returns & Exchanges
We accept returns of non-bespoke products within seven (7) calendar days of delivery, provided the item is in its original, unused condition with all original packaging intact. The buyer is responsible for the cost of return shipping.
Refunds will be processed within fourteen (14) business days of our receipt and inspection of the returned item. Moonarts reserves the right to decline a return if the product shows signs of use, damage, or alteration.
7. Intellectual Property
All content on this website, including but not limited to text, images, logos, designs, and graphics, is the property of Moonarts and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent.
8. Limitation of Liability
To the maximum extent permitted by law, Moonarts shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our website or purchase of our products. Our total liability shall not exceed the amount paid by you for the specific product giving rise to the claim.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
